I thought my problem with Fonetastic had been solved but obviously not...they have stopped sending the FoneTastic football texts and now I am being harassed by ones from them telling me a company LUUP has 2 for me! I've had over 8 messages today!! Does anyone know if these are costing me and how I can stop them? I have already e-mailed Fonetastic.

According to in-house documents, which are available to FTD [Financial Times Germany], Zed reactivated cancelled subscriptions or demanded never existing subscriptions. (...) Dietmar Giese, manager of zed, denied the allegations: The network providers are to blame for the incorrect billings

It appears from the hundreds of identical complaints that Sonera Zed UK Ltd are operating the same stunt here.

I am worried about an SMS i have received...     Post a reply to this message

Promotion Number: 8007 - Hi.

I have recently received two SMS messages. The 1st one said 'Ringtone Club' from 'Ringtone Club' and had a link to a WAP site. The 2nd one was from '84437' and said: "U are subscribed to the best Mobile Content Service in the UK for 3 per ten days until you send STOP to 84437 Helpline 08706091720"

I am not sure what i should do. I am worried that if i send STOP to 84437 will i become trapped in their scam and be charged more money? And is the number 08706091720 just a 'fake' number?

I hope someone can give me advice on what i should do...

Regards,

Before I changed my sim card I had a total of 22.50 taken from my pay-as -you-go credit despite sending STOP messages. The money was being taken with the message 'Your ringtone subscription has been renewed.'
I contacted Newsbeat at BBC Radio 1 and was given a customer services email & phone number for Zed. 6 months down the line I am still waiting for a 4.50 cheque I was told I'd be getting as a refund.
In short these companies are being run by crooks. No other description for them.

Agreed there are an infinate number of loopholes availble to the unscrupulous content sellers out there, I think the point i am trying to get across without obvious clarity is that GETZED have advanced by leaps and bound to bring some scruples to the industry as a whole and try to set example for appropriate advertising, we operate well within the law and try to solve our consumers problems, I think that in my opinion companies such as those who made people crazy with a nude amphibian, do not have the same intersts for longevity that zed wish to have.

In any industry there are always those that will try and make a quick buck at the expense of other more honest companies, yes we make mistakes but they are obviously constantly over exaggerated due to the negative image the industry as a whole has recieved due to a few bad apples, unfortunatly a couple are big players who should have been setting an example but chose not to.

Re "abuse" posted by Grumbletext the mgnt. at 8:41 30/11/05 ...

To build on Adrians comments, I can think of posts where a "new out of the box handset" has proved to have a recycled number that has resulted in the new owner being billed over a prolonged period (possibly for asomeone else's subscription) and where the STOP command has been repeatedly ignored, and even a case in recent weeks where a network confirmed that no subscribe message had been sent despite assertions from the scammers that it had. The truth is this "industry" is rife with loopholes that are being exploited by some companies that seems to exist to scam people in any way that they can.

You have a rose tinted view of your industry, and it really is a matter of shame to all concerned that the statutes have not been modified to curb these abuses, such as shortcode bars on request of handset owner, and signups only from requesting handset, AND requiring second confirmation message. If those involved (your industry and the networks) were really concerned about this they would put these simple safeguards in place, but I guess the lack of shortcode barring shows that those concerned are afraid of how much money they could lose if the scams were halted.

I would also lend my weight to the comments made by Adrian about personal attacks, its easy to respond to people without getting down to a personal level, had I been around sooner I would have been deleting passages from messages where this occurs (as I have done in the past in many threads), and I will be removing comments of that nature that I see from within future posts.

We know we are right, there are scams being operated on a daily basis by shortcode and Premium rate operators despite their assertions that its all our fault. Speaking personally, I would ban all shortcodes - I would certainly like my network operator to bar them from my handset, I have no use for them at all

I am not saying that he should not complain, i am trying to point out that while definatley there are companies who send out MT's to random numbers, Zed, simply do not follow this fraudulent practice. So again with direct reference to GETZED the poster MUST have at some point ordered a peice of content for the getzed service.

That is all i am trying to point out.

From Adrian at Grumbletext - the GT site is also not a fan of personally aimed abuse. I suggest that the poster takes up Fawie's offer and PMs them the details.

However, ref fraud in the industry, and this is a comment NOT aimed at Getzed (which is not the same thing as saying we have specific reason to believe they are or are not involved), there certainly is fraud in the industry, it is very clever how it's done but we now know how it's done, and in conjunction with others, I can say with some certainty that there are companies, not necessarily the smaller companies, in the space, who are not going to have a very pleasant Christmas.

THe point of the above is - I've seen posters accuse people on Grumbletext of having nothing to complain about, that they MUST have subscribed - this is simply NOT true. Whether or not it's true in the case of Getzed, we have no idea at the current time.

No reason for abuse, but i do not take it personally. Zed more then anyone else in the market try to be as transparent as possible in it's advertising. You MUST have subscribed at some point in time, perhaps again you got a ringtone unknowly realising it was a subscription.

Not too sure who ICSTED is nor probably does anyone else on the planet, But Zed work together with ICSTIS to ensure the utmost transparency in our marketing. Can i suggest you PM me with your number and i will see what is going on and try to get it sorted out for you. Not interested in abuse, so do not waste your time sending it as i will not read it

I personally think you are a dick. Have you not read the comments on this site. My complaint against getzed is currently being investigated by ICSTED - supposedly....GETZED have even had the cheek to phone me personally alleging that I have subscribed - BOLLOCKS have I. Let them prove it on paper - ICSTED wanna get on top of this - does FRAUD mean nothing these days !!! You obviously have more money than sense if you are happy with the way this so called company are trading - either that or perhaps no scruples.....

GETZED     Post a reply to this message

Promotion Number: 8007 - All of Zed's advertising clearly states that it is a subscripition service, while i agree that most of the people get into it making the assuption that it is a one off, i cannot get past how they miss the fact that it is a subscription service.

Also as far as all the billing etc etc, It is difficult to understand why people go on about never having subscribed etc etc and i am getting all these billing messages etc etc.

You have obviously requested a tone at some point or a wallpaper or something else if you have'nt your kids probably have.

I agree it is a pain in the bum but instead of complaining and saying there is no recourse, why not read the texts you get which clearly mark the customer service number and give them a call, also keep in mind the command is "stop" on it own, not "please stop" or "Just Stop" or " enough of this, stop"

If any of you are still having problems as far as getzed is concerned please send me a PM, I don't want to get into an arguement with any off you so please no abuse or threating to murder my first born.

I can not stop these B*****DS sending me Texts, I have tried the STOP and have there reply stating I have been unsubscribed from ALL ZED Subscriptions and the SELECTA Tone on 16/09/2005 17:51:20 but today but 10 on my phone and within minutes received FOUR texts from them exactly the same and they've stolen yet another 6 !!!!

I have spent 2 and a half hours in there queue where you can quite clearly hear them pick up the call and transfer youback into the queue, and even pick up the call ( you can hear them talkin in background !! ) and give you an engaged tone and then disconnect the call.

I have rang ICSTICS who said I have to keep trying them but surely there must be something else I can do to stop these thieves ! the text messages are coming in from 80078 saying

"Ur Selecta Tones r ready to collect. Txt S1 for ....." and so on, how can they repeat the same message 4 times and charge the same for each instance, if this is legal surely I can walk into a bank and help myself in the vault !!!!!!

Promotion Number: 8007 - I posted a grumble last week, still getting jokes. I've been back on to O2 and now they've told me to text STOP ALL to 8007 and this will definately work, but I see many complaints on grumbletext about not being able to stop texts which are coming from 8007, so I don't have much faith. I haven't tried yet as I have no credit on my phone as it has all been used up receiving jokes I don't want and siiting in a queue waiting to speak to O2.

Promotion Number: 8007 - Re "Re: GetZed Ltd (80078)" posted by Grumbletext the mgnt. at 16:37 08/09/05 ...

This has been really helpful interms of information, if not solutions. I'm looking into these texts sent to a friend's phone, and which have so far cost her 18 in less than a month. She is a pensioner who has been really bamboozled by this, did not set the service up, and had no idea how to stop it. She finally got it stopped after the company from whom she bought the phone (Phones4U, incidentally) very reluctantly and with bad grace made some calls, but insisted it was of her own doing.

As she did nothing other than read a text sent to her, uninvited, in my opinion that amounts to illicit theft and from someone who can ill afford it. From reading the thread it seems that nothing works - STOP, complaining to the company or ICSTIS and I'm now really pretty depressed! My friend is now petrified about using her phone which she bought to make her life a bit easier, and has just received another spam text from no. 80070. Doesn't seem right to me.

Cheers all.

ref Guest'ss thoughts:

There is certainly room for this point of view, and I have from time to time wondered if it's better to learn young about professional scammers at a cost of 30-40 rather than find out as an adult for 3000-4000 and you'll see there are plenty such cases all over this site.

The only point I wanted to disagree with was as follows - Guest said:

"At the end of the day you would not be charged for text messages unless you originally sent of a txt for a 'free' ringtone is the first place. "

This is simply incorrect. There are a variety of ways you can get signed up to these services without sending a text message. I have had an email communication with one of the major UK operators today discussing this very problem - they concede quite explicitly and openly that sending a text to one of these services is by no means the only 'valid' say to 'sign up to' on of the 'subscription services' (e.g. ringtones). The big problem is WAPsites - people receive a WAP message which poses as a 'service message' in your 'Service Inbox' - your only option is to 'Retrieve' the service message. By retrieving the service message, you are actually navigating to the service's WAPsite, and accidentally registering yourself for the 'service' (e.g. a ringtone subscription) without having any idea that you are doing so.

The WAP message has sufficent info in it about your phone (ie the number) that by your simply retrieving the 'service message' the WAPsite owner can claim that you went to their site and signed up to their terms and conditions - there is no way that you can practically disprove this.

Frankly the whole mechanism is very similar in spirit and covertness to the premium rate rogue internet download problem, or catching spyware in general - all the script is hidden so you have no idea what is going on. Anyone who downloads an antispyware program and runs it for the first time is usually amazed to see all the spyware they have picked up without being in any way aware of having done so.

Just my 2c.. Cool

I do not agree with most of what warweezil has rambled on about but this part i did think was correct:

3. (To some extent) People. There is no such thing as a free lunch, but so many adults seem to think there are free ring tones/wallpaper/whatever being provided out of the goodness of some benevolent corporate desire to brighten up our dull lives. Fraid not! Usually the small print tells you that the freebie will lead to you paying through the nose. Sometimes the company just doesnt give a damn about UK law operating from a "safe haven" behind shell companies far far away. Yes I know kids get sucked in, but its up to us to educate them in the cold harsh truths of this world, there are people out there who make a living ripping others off.

At the end of the day you would not be charged for text messages unless you originally sent of a txt for a 'free' ringtone is the first place. It makes me laugh the amount of 'Adults' who claim they were ripped of for being subscribed to a ringtone service when they originally sent of a text message in the first place. Also the 'little angels' who tell mummy and daddy that they never sent a txt message to a company...parents you gotta realise your son or daughter is not the angel u think they r and they can b silly enough to ask for a 'free' service... At the end of the day if the person using the phone is responsible for txtin for a 'free' tone they should be responsible for asking mum and dads permission before sending it!!!!!! Is it just me but if I see an offer for something free i automatically read the terms and conditions before hand!!!

On any forum that is properly run, posts have come and gone, sometimes they are removed for being factually incorrect, sometimes for stepping over the boundaries of taste and decency, others because they are outright "flames". I have no idea what you posted in critisism of Voda, but as a member here I know he did seem to be genuinely trying to help, had the opposite been true I am sure the forum proprietor would have said something. I am puzzled why you feel it is now appropriate to post a critique of Voda as a site search reveals he hasnt posted here in several months.

You seem to hold the networks wholly at fault, and yet the fault for the whole scam situation rests equally in other areas.
1. The law. The networks would have to be 100% certain they could show good cause before they were to bar any company from sending texts (assuming they were able to techically) because the legal wrangles would be immense and expensive. The law should provide for an immediate disconnection where a problem can be shown to exist. Payment should be witheld for 45 days in order to give people on contracts a chance to receive and check thier bills to raise queries about "rogue" charges.
2. The regulator. That description is really a bit of a joke, poor old ICSTIS the near toothless watchdog is really quite ineffectual as the many posts on this site documenting continuing problems with the same old names proves. It is time that ICSTIS was given the power to immediately bar any company from operating where a problem is shown to exist.
4. The Networks for blindly accepting that all shortcode messages are legitimate and "solicited". The law needs to be changed to prevent sign up to these "services" by any other method than from the "requesting handset", there should be a requirement for a second message in confirmation of a subscription request, and Networks should have to show records of such requests if challenged by the phone "owner".
Rather than dismissing the "stop" requirement, complain to "everone and his dog" if it doesnt work, according to UK regs it should, you might also like to reflect that many of the posts here are from outside of the UK which may not have a mandatory "stop" solution.

Im not saying the networks are innocent, after all I am sure they could allow us the option to block shortcode texts IF they wanted, but they are not as guiilty as the politicians who can legislate at the drop of a hat when it suits them, but I guess as Government gets a tidy VAT rake off from these scams they can afford to turn a blind eye.

One thing is certain, just bitching in here wont change a thing, take the time to make formal complaints in writing, involve your MP, hassle your network provider, all these things are useful. Dont forget the Information commissioner has responsibility for unsolicited text messages. If we wait for someone else to fix this, it will never be fixed and SMS will end up like e-mail, full of garbage that was neither requested nor required.

I am surprised at the censorship on this site, where a post that disagreeable is removed.
A few days ago I posted a reply on this thread wherein along with complaining about getzed I also roundly critisised Voda for his apparent championing those low life thieves.
I also suggested that instead of supporting them Vodaphone (and other mobile providers) should spend some of their ill gotten gains to wipe out these crooks. For crooks they are. All the guff spouted about text STOP or STOP ALL. Read the posts on these threads IT DOESN'T WORK.
Obviously my post came a little too close to home and was deleted. It was there 'cos someone replied and I got an email to tell me there was a reply, and a link to my post
http://www.grumbletext.co.uk/vt.php?p=12727#12727 strangely the post no longer exists.
Shame on you
I suppose that means I'll get the push now for dissent

Its NOT a solution, the networks will simply disconnect for the outstanding amount. If it were that simple this whole site would probably not exist. The law covering this area is weak, the "watchdog" (Icstis) is toothless, and the whole situation is a joke. We should have the right to opt out of premium rate texts completely, that would stop dead all of these scams, either that or outlaw the whole premium rate text thing as it seem to be getting uncontrollable. That would scare the networks into sorting out thier act. But simply not paying, thats not an option.... try it and see.... if you dont mind being cut off.

The best way to get around this problem is to get a contract phone. This way, when you recieve your bill at the end of the month you can read through your list of phone calls and take away any costs that were incurred through 'rip offs'. Then send off a cheque only paying paying for what you should be. When your service provider then phones you up, refuse to pay for the rip off messages that you didn't even request in the first place. This way your service provider will have to pay and might actually do something about it for once. All service providers have the power to block these companies but choose not to as they will lose income.

Im a student in alot of debt and i think it's disgusting that these companies pray on the likes of me, and other hard-working class people. I bet the owner of get-zed is cruising around in his/ hers Ferrari right now, which we paid for! It's simply theft and makes me sick.

Choose a nice cheap contract and have your pay as you go number transferred over to your new sim. I hope this advice helps some of you out there....[/b][/color]

Promotion Number: 8007 - I like others have been receiving text messages from GETZED. Each time it has happened I have replied STOP to no avail. I have also sent COMPLAINING emails to [email protected] which I have never received replies to. Orange Payasyougo -- don't seem to be able to do anything for me.
I got a number for GETZEDs customer services 08706000933 and complained -- they sent me a refund of 6 pounds --- I suspect they have cost me a lot more than this. I thought this would finally be the end of it but no! I got more texts last week.
This is fraud -- can no-one do anything about this ???-- IT IS A DISGRACE!

Promotion Number: 8007 - I wish the people who enjoy themselves so much working for GetZed would spare a thought for all the poor people who are funding their donut eating habits courtesy of their scamming techniques ! My daughter has received 3 texts costing her 9 which she did not request in the first place. I don't know where they get phone numbers from, but this surely is illegal.
I have reported them twice to the Trading Standards Authority, and received an email after the first time saying we would be reimbursed, but are still waiting. They also said my daughter's number would be removed from their lists and that it was due to a system error, but she has had more credit stolen since, so thay can not be believed.

Please, please, please, can I have some of what you're on?
GetZed are, always have been and always will be the kind of business you would love to get your hands on in a very iffy version of Monopoly (the game). For the unscrupulous only. Wot no bagels?

Yes, I know it's a wind up, it must be. Isn't it??

I also keep having a subsrcription to Zed renewed. A subscription I never asked for in the first place! I rang them up after getting their number from Orange and they sent me a 5 voucher for HMV. Considering they had taken 9 from me without my authorisation I wasn't exactly happy but thought it was better than nothing. They promised to remove my details and said it was a technical hitch but they have now "renewed my subscription" another two times in the past two weeks. I have e-mailed them twice but heard nothing back. It makes no difference how many times you text STOP, they just end it and then automatically renew it.

'STOP' does not work with getzed.

I was scammed over a period of weeks at the tail end of last year. After some investigation and very little help from O2 I managed to 'STOP' the service. The did me again in April this year and I complained to ICSTIS and Sonera Zed and received a refund of 2. I took the precaution of not only sending 'STOP' but also blocking incoming messages from the two numbers they had been using (80076 and 80078).

They started again for a third time last week and have got round the block by using two different numbers (80070 and 80077). I have contacted them again and have been given the same lame excuse that a technical hitch has resulted in these being sent accidentally. I asked for a list of the numbers they use with a view to blocking them all. I was informed they have between 300 and 400 numbers at their disposal. If this is true then obviously blocking them all is simply out of the question.

Having read many of the posts on this site, I am dismayed to see there are individuals who are complimenting them on being one of the more reponsible providers of this type of service.

They seem pretty determined to overcome any obstacles I put in their way. In short, I have no control over this immoral, if not illegal activity.

I understand that the government is proposing tough measures to combat this type of activity. It cannot come soon enough. These crooks must be stopped. Hopefully they will force the network providers to start looking after their customers. My provider O2, like so many others are not prepared to offer refunds or take any kind of sanctions against these rogues who are abusing their own customers. I suspect that O2 and others are happy to perpetuate this activity in order to keep revenue at a maximum. My suggestion to O2 that I would deduct the cost of these unwanted intrusions was met with a threat that if I did not pay my bill in full, they would barr my handset. I suspect that I would also be branded a bad debtor. I'm in a no win situation.

ICSTIS have so far done nothing about my complaint of 3 months ago and have simply added this week's complaint to my file.

Zed may have re-imbursed the charges the last time, and possibly will do so again. But, will the compensate me for the considerable time spent chasing them up and making numerous telephone calls, which I have to do from my place of work. I have yet to visit the bank to find out whether or not the cheque is of rubber variety.

Promotion Number: 8007 - I do not ever want to be sent messages again getzed to my mobile phone.
I recieved TOXIC & EASTENDERS messages in my service in box. I have never asked for and do not wish for these communications and resent the companies practises - stealing money from people is not a profession to be proud of.

Getzed     Post a reply to this message

Promotion Number: 8007 - Over this weekend, Getzed has STOLEN via unsolicited text messages in excess of 6 from my daughter's Orange Pay As You Go account. She hasn't subscribed to ANY ring tone provider, including Getzed and therefore I take this to be quite simply THEFT. It would appear that texting 'STOP' didn't work! I can only hope the company get taken to task. Let's face it, if someone removed funds from a bank account without permission, the Police would be informed that a theft had taken place and an investigation would commence to identify and process the offender. So, what's the difference?
