Can you please help all of us to resolve this scandelous occurence with out mobile phones. I have now been charged upwards of �400 by orange due to the premium rate text messages thta i have NEVER subscribed to and have never recieved !!!

I too have been receiving these txts. Mine started after ordering ringtone from Yahoo, I have tried contacting both Yahoo & Virgin but so far, no luck. It has got so I cannot add credit to my mobile for fear of it being eaten away by charges. Anyone got any ideas?.

I agree - my 14 year old son managed to download Crazy Frog at a total cost of �64 and rising. I have tried unsuccessfullly to get confirmation that his premium rate texts have been stopped. The TV ads did not vocalise the hidden charges - a strip along the bottom of the screen did not register with a 14 year old. - and there was no verification process that confirmed my son was of age. What a scam. No wonder they take millions of � in profit. They know full well what they are doing to people who can least afford it.

I ended up being asked to pay $25 for 1 ring tone.
To cut a very long & frustrating story short, I rang them and asked the call centre operator (an American man) what he thought of this and he just went on and on about all his marketing crap blah blah blah.......In the end I cut him off and said 'Listen mate! I have received 1 ring tone from you guys & now your asking me to pay $25!!!!???
You must be joking!
Then he hung up on me.
I was furious so I rang back, eventually speaking to an indian lady who was very kind (although a bit hard to understand) and she eventually apologised and arranged a refund & cancellation.
The bottom line is:-
These Ringtone Companies Are Making A Dishonest Living Off Small Print & Late Night TV Add Scams.
They have guys with university degrees on how to rip you off without you realising your being ripped off & they do it all LEGALLY.
My Advice Stay Away From All Of Them!
Jamster = Scam Artists Who Beleive You Should Pay $25 For A Ring Tone Then Hang Up On You If Asked To Explain Why.

I HATE JAMSTER NOW & WILL BE TELLING AS MANY PEOPLE AS I CAN ABOUT THEM!
WHY IS THIS WORLD SO FULL OF RIP OFF PEOPLE???? DOES ANYONE OFFER A GENUINE SERVICE ANYMORE?? The most annoying thing is they get money into thier account from yours for doing absolutly nothing while I'm out there cutting wood & slaving my life away for every buck that comes in............Maybe I'm just in the wrong business

Hello, I realised last night I have been unwittingly supporting some scam and have in the last 3 weeks only lost �13.50 to them.

I have never subscribed to any competitions or ringtones, and Virgin say they have never heard of these numbers....
After finding your website today (thank goodness), I realised this number has associations with Virgin it seems.

1) I want to find out who gave my number up for subscription
2) I want 'oner and above' compensation for the inconvenience and 'theft' that has been occuring at my cost
3)I want to take legal action. I feel very strongly about this, and will appreciate any pointers or help in order for me to nail the cuplrits.
4)I want to make more people aware of this scam, as I'm sure many people are paying without noticing it (I only noticed yesterday, and Virgin says it has been going on from at least before April).

Thank you for the brilliant support and work so far.

Hi

If you get no joy from Jamster, contact your network and complain through them. Ask your network who their service provider is (MBlox?) then complain through them as well. You will find that Jamster will very quickly phone you.

hi, i was wondering if you had the tel no for jamster as i dont have it and cant find it on the website, they have swiped all my credit and told me i had to wait 15 business days, and the only way i could get it was through my bank, i told them to post it but they told me they dont do this. i am very angry as its been 4 weeks and ive had nothing

Try telling them it is your child's 'phone and the child dielled up for the ring-tones as I believe they are not allowed to accept instruction from a minor and may wish to reimburse you. This happened to me with Jamster and my son got me up to �75. They have said they will reimburse me. We'll see!

Anyone had problems with Stealthnet.com sending SMS messages for ringtones??? I used to receive three messages at a time which I just deleted. The only thing was I did not realise these messages cost me �1:50 each. I ended up being �69:00 out of pocket. I tackled O2 and Stealthnet but got nowhere with a refund. The quicker we outlaw thes scams the better it will be.

I received this message and although I hadn't come across this website until today I am happy to recommend that people who have suffered from premium rate rogue dialler problems at least examine this site - I do not know those involved with it so visitors should make their own enquiries.

www.premiumratescam.co.uk is about consumers who have been scammed by premium rate rogue internet diallers banding together to sue British Telecom, BT, into refunding them the money they have lost - I personally happen to suport with their plight.

Pls be aware that this is ONLY to do with rogue internet diallers - it does not cover premium rate landline numbers (ie 090 numbers) in general

I'm very interesting to take legal akction against Ringtone/Picture club. I've �90 worth of messages that I never opened,requested or subscribed. T mobile gave me 3 telephone numbers,but it's not possible to contact third party services.I was trying 100s times hearing ansver machine.t mobile rather protect those thiews then their customers.
Maby I shouldn't pay my next bill and send my mobile bill to rington club?
How can I get my money back?

Couple of comments:

It seems that the unsolicited texts are criminal, not 100% sure on the legal details, but chasing this down. The mobile operators are obliged to provide you with the details of the companies sending the texts, so that you can make contact, insist the texts are stopped and pursue them for damages, which should include ALL expenses and compensation for the distress. Whether criminal proceedings take place or not, does not affect your civil rights to pursue through the courts.

The mobile operators always response that it is too dificult or they cannot give out the information on the source of the texts. You can obtain a County Court warrant to force disclosure, about �25, and the operator must disclose to you and the court. If they do not, then they have to explain to the court why not, i.e. you have a powerful allies in your fight.

A County Court claim for damages is also inexpensive, not sure of the cost, but of the order of �25-�50. Because the texts are essentially a variation of fraud/theft, the law is on the recipients side, so worth using to stop the mobile operators hiding the identiies which hampers pursuit of the offenders.

The more people who do this the better. The more publicity about court proceedings against mobile operators and the sources of these texts the better.

My text problem is non-exsistant compared to yours, but it still winds me up.

My son was brought an all singing all dancing Sony mobile on the O2 network by his Gran as a gift back in May 2004. He's had nothing but trouble with it since it was purchased and his latest bill from O2 is for �353! All bar the line rental are unsolicited premium rate texts. Despite phone call after phone call to O2 they insist there is nothing they can do. I will be advising my son to pay his bill minus the cost of the these texts which since May last year have cost him nearly �700! Added to that, as his bills seem to take an eternity to get to him, any payment made arrives late and as a result he can no longer make any calls or send any std rate texts - yet he still gets charged for the premium rate ones. This whole situation is ludicrous - who in their right mind pays for something they never asked for - would you? PLEASE take all appropriate actions to get this stopped.

My son's telephone bill through Orange has just come through at over �300 - 2/3 of this is due to unsolicited text messages. Orange can do nothing.

My 11 year old daughter has a mobile on Vodafone network, the customer service provider being Singlepoint. HAving responded to a couple of ringtone adverts, she was then inundated with premium text messages, sometimes just seconds apart, costing �1.28. In all, over a period of 7 months, I have paid about �140 for these messages. Phone bills give no details on where they are coming from. I started complaining in April or May last year and was told to text "STOP" by Singlepoint. They could not give me any mor information. Still the unwanted texts came. Singlepoint kept referring me to Vodafone and Vodafone did not want to know. ICTSIS was useless. Eventually in October, after hours of pestering both Singlepoint and Vodafone, I was given a list of about 10 telephone numbers to call to stop the texts. So far, no further texts have been received.

Hi Adrian,

I'm all in support of you going out and getting legal action against these perpetrators! I've just been scammed myself from a company called 'Voicefirst ltd'. At least I'm pretty sure they were con's as they fit the bill. Also I did a search at the end of the recording on the address I was supposed to send a self addressed envelope with my address etc and the address to be posted to seems to not even exist under that companies name!?! Perhaps you've already come across this one, for 95 Wilton Road promising a free holiday or BMW or cash prize. Anyway. I've never even heard of these phone scams believe it or not! I thought its harmless calling because it was all pre-recorded and so there was almost a feeling of non-intrustion but when I hung up, I dont know I just felt that somethings didnt add up. Thats when I stubbled on this site. I think its wonderful!

My question is...how involved to you need me to get from this point onwards?
and what happens if you win? Do you think we will recieve any compensation for this because I'm not yet sure how much that call would have cost me?! I really hope we catch these culprits becuase other people are sure to be scammed too.

I know where you're coming from but I do think that there are important differences:

1) Sales of UK arms - the only people with an incentive to sue are the poor blighters at the other end getting shot; clearly those people are not in a good position to sue! The whole issue of international boundaries clearly complicates this massively as there is no exclusively internal UK comparison

2) The B & Q example to me is much more relevant and I'm just going to make a quick common sense point; I have no idea how this translates into law:

- if you manufacture or sell a spade you may, if you stop to think about it, realise that it could be used to commit a murder - it is possible to conceive of this happening in very, very rare instances. Also there is no particular distinction to the spade since there are so many other household items which you could commit murder with.

- with premium rate lines, it is both possible, probable, highly likely and in fact almost certain that a material percentage of the network operator's lines are going to be used for fraudulent purposes. The network operators are in full knowledge of this becuase their clients have been fined so many times by ICSTIS. As it is therefore a normal and anticipated use of the product/service rather than an abnormal, unanticipated use of the product, then I believe (and am getting now some legal suport to suggest) that there is a strong argument to say that the network operators owe consumers a duty of care in this situation

I know this is a rip-off but a similar situation is where the UK arms industry supplies 3rd word countries with weapons. Are the manufacturers going to accept liability for the genocide they cause? I think not.... Too much money involved.
You cannot sue B & Q because they supplied the spade that the murder was committed with (or the manufacturer for that matter)
I think education is the key here....

I didnt even know that they were using my line Opal Telecom have managed to con me out, I received a phone bill for �193 its never exceeded �70 & I dont know how Im gonna pay the bill & I keeping riging the regulater to stop them from using the line but it is ALWAYS engaged. Crying or Very sad
